Deceived real estate buyers will be supported: The Supreme Court is changing the practice

The Supreme Court of the Russian Federation has announced the preparation of important clarifications regarding the challenge of real estate transactions that were concluded by citizens under the influence of deception. This was stated by Chairman of the Supreme Court Igor Krasnov at the annual meeting of judges with the participation of Russian President Vladimir Putin. Protection of citizens' rights in housing fraud According to Igor Krasnov, the issue of challenging residential real estate transactions, including those made under the influence of deception, is causing a wide public outcry. In this regard, on his instructions, the Supreme Court will prepare relevant clarifications in the first half of this year. The main purpose of the document is to bring order to this legal area and ensure a uniform approach to the consideration of such disputes. Liability of management companies and housing disputes In his speech at the final meeting of judges, the Chairman of the Supreme Court of the Russian Federation also touched upon other issues relevant to the population. He noted that a significant part of the court proceedings are disputes related to the implementation of housing rights, as well as conflicts between tenants and management companies due to poor-quality provision of public services. Igor Krasnov emphasized the position of the courts in such cases: management companies are obliged to bear full responsibility for violations. "Courts should keep in mind that in such cases, it is these companies that are responsible for full compensation for damages and compensation for moral damage at the request of persons whose rights have been violated," he said. Plans to adjust judicial practice In addition to housing fraud issues, the head of the RF Armed Forces pointed out the need to adjust the practice of applying land legislation and compliance with urban planning regulations. The work plan of the Supreme Court for the near future includes a summary of key decisions on cases of unauthorized construction, as well as on the use of lands belonging to specially protected natural areas. Context: the President's position and new control mechanisms The announced clarifications were made against the background of important statements made by Russian President Vladimir Putin at a meeting of judges of courts of general jurisdiction, military and arbitration courts, which took place on February 19. The Head of State emphasized the need for the Supreme Court to respond in a timely manner to changes in law enforcement practice. "The Supreme Court must respond in a timely manner, form common approaches and explain them to the courts, and actively exercise its right to legislative initiative," Vladimir Putin said. The key proposal of the President was the creation of an effective system of monitoring and control over the implementation of the decisions of the Plenum of the Supreme Court in the Supreme Court. "I would like to emphasize that the formation of uniform judicial practice is possible only if judges strictly comply with the decisions of the Plenum of the Supreme Court, and every case of ignoring them should receive a principled assessment," Putin said. Thus, the preparation of clarifications on real estate transactions will be one of the first steps in implementing a new approach to ensuring uniformity of judicial practice.
