Garage Amnesty: What you need to know

The law on the amnesty of garages was released in 2021. Thanks to the amnesty, you can get ownership of a major garage for free, as well as the plot on which it is built. The procedure is simplified, as it does not involve registration through an appeal to the court. So, single-storey garages with foundations and erected walls fall under the law. Also, the garage must be built before 12/29/2004, and not be self-built.

They are not suitable for amnesty:

– structures without foundations, for example, metal structures of the "shell" type;

– capital garages built after 12/29/2004;

– extensions to private houses, dachas, commercial facilities;

– parking areas in high-rise buildings, underground garages;

– buildings to be demolished or recognized as self-building.

As a rule, a complete list of documents is compiled in regional departments.

They are accepted for consideration:

– old registration certificate for the garage;

– papers that specify the date of construction of the garage, for example, purchase documents;

– the decision of government agencies to allocate a plot for a garage;

– a document confirming the payment of a share contribution to GSK;

– inheritance documents;

– receipts, as well as other papers with the date of construction.

If the garage belongs to a garage cooperative, it is allowed to contact its chairman in order to obtain the information necessary for amnesty. For example, the latter should keep certificates of membership in the GSK, copies of contracts and the charter of the cooperative. When all the documents are collected, the land is put on cadastral registration. The speed of solving this issue depends on the availability of the necessary documents and the location of the garage. First, they prepare a diagram of the boundaries of the site, and then send it with a package of documents to the organization to which the territory with the construction belongs. After agreeing on the provision of a plot, the garage is registered and ownership is registered. The amnesty process usually takes from 3 to 6 months.
