Owners will be able to return overpayments on taxes when revising the cadastral value
The Federal law "on amendments to certain legislative acts of the Russian Federation" came into force, which concerns the procedure for making calculations when changing the cadastral value of a real estate object. This law is intended to affect situations where the established cadastral value of objects significantly exceeds the market price. In this case, the calculation of the state cadastral registration authority is considered erroneous, and the new bill directly addresses this issue.
Main aspects of the Federal law
The adopted amendments carefully consider such situations and offer a solution mechanism that is much simpler than the generally accepted approach. Not so long ago, in order to challenge the decision of the cadastral Commission, you had to submit an application to a special Department of Rosreestr or go to court.
According to the new law, in order to challenge the established cadastral value, it is enough to submit a request through the MFC.
When the owner's request has all the grounds, the changed price is considered relevant from the moment of entering this data in the usrn. As a result, owners can recover part of the taxes paid in accordance with the old cost, which is currently considered incorrectly calculated and irrelevant. In cases where the cost of an item has increased during the period when the request for changes was considered, the updated price starts to apply from the next year.
If the incorrect calculation concerns a group of items, the calculation is performed for each item in this category. For example, this evaluation method is applied to plots in horticulture. If one of the owners submits a request to change the value, the cadastral value of each item in this group will be recalculated.
In addition to the recalculation mechanism, the law establishes a rule according to which taxes can be calculated only at the cadastral value that will not exceed the market value of the object.
The cadastral value of any property must be reviewed every four years – this rule applies to land plots, capital buildings, and Parking spaces. Control over this procedure remains with Rosreestr, as well as recalculation of the cadastral value at the request of the owner. Timely verification of changes in the cadastral value will allow each owner to get up-to-date information about the value of the property.
