Privatization of state and municipal property
Federal Law No. 293-FZ dated 31.07.2020 defines amendments to certain provisions of the Federal Law "On Privatization of State and Municipal Property". The provisions of the Federal Law are designed to improve the procedure for the privatization of property, to establish a unified approach to the privatization procedure.
Among the most important changes concerning the procedure of privatization of state and municipal property, it is possible to distinguish: establishment of a new authorized federal executive body that will carry out regulatory and legal regulation of all issues related to privatization; definition of additional requirements for the planning of the privatization process; clarification of the procedure for providing accounting documents on the results of privatization.
The innovations also touched upon such difficult situations as the privatization of property without inclusion in the privatization program, the privatization of gas networks, the sale of property to a single bidder, participation in the privatization of leased property of socially oriented non-profit organizations.
Let's focus a little more on the most important changes.
Since 04/24/2020, the Ministry of Finance of the Russian Federation has been engaged in the development of state policy and the formation of regulatory and legal regulation in matters of privatization. Now the Ministry of Finance can submit to the Government of the Russian Federation draft decisions, proposals to change or cancel decisions on the conditions of privatization of property. Before the changes came into force, these powers were vested in the Ministry of Economic Development of the Russian Federation.
The requirements for the planning of privatization programs and the presentation of data on the results of their implementation have also changed. Now the subjects of the Russian Federation and municipalities must determine the procedure for planning privatization in accordance with the developed programs,
and also prepare data on the results of privatization every year by filling out uniform forms.
When preparing a privatization program, it is important to comply with certain conditions: the duration of the program is from one to three years, the development and approval of the program is handled by the Government of the Russian Federation, state authorities and local self-government. The approval of the program is carried out no later than 10 days before the start of the planned period, and it is necessary to publish the program on the Internet within 15 days from the date of its approval. The program contains data on property and potential income, property is distributed by sectors of the economy, and the results of the privatization program are provided in a single reporting form.
