How and why to check real estate for arrests and restrictions
Do you need to check the property for legal "purity"?
When planning to buy an apartment or a house, do not rush to conclude a deal. Be sure to check the property for arrests and restrictions. So you will protect yourself from unpleasant surprises. Here are the typical ones: the object is seized due to debts (for example, to a bank or housing department); Transactions with this property are limited, as the heirs have not yet distributed their shares; the apartment or house acts as a collateral against which the loan is taken; housing appears in the lease agreement, which has not been terminated, etc.
Since the laws of the Russian Federation prohibit entering into transactions with such real estate, the contract of sale of the "unclean" object will be canceled.
The buyer will lose not only time, but also part of the funds, because it will not be possible to return them in full.
As you can see, there are good reasons to spend time checking out the apartment you like. Rosreestr will help to do this, where information about the arrest and other types of encumbrances imposed on real estate is mandatory.
How to "look" in Rosreestr?
There are three ways to do this: Via the Rosreestr website. We go to the site, enter the address of the object of interest to us and form a request. In the "Restrictions" section, you will see information about the arrest and other encumbrances imposed on the object. If there are none, then there will be an empty line in the "Restrictions" section. This method is simple and free, but the information on the Rosreestr website may be incomplete or not updated for a long time. Through the MFC in person. To do this, we come to the nearest branch with a passport, fill out a special form and get a receipt for accepting the request. The statement will be ready in 5 working days (the service is paid). Via Internet services (paid paper or electronic statement). Open the site, enter the address of the object we need and send your email. Then we go to the payment field and transfer the funds (an electronic statement is much cheaper than a paper one). After that, the password from the personal account is sent to the email, after entering it, we see the status of the application – for example, "processed". As soon as the statement is ready, the customer will be notified of this by letter to the same email (and some services - in an SMS message). The electronic statement opens easily in your smartphone or computer.
That's all – you have protected yourself from fraudulent scams, loss of time, nerves and funds. We wish you profitable deals and successful acquisitions!
