Changes to Federal law No. 218
10.08.2020 amendments to Federal law 218-FZ "on state registration of real estate"came into force. They also touched upon issues related to land surveying. Without specifying the boundaries and coordinates of the land plot, the owner cannot dispose of it: it cannot be sold, donated, or divided.
Land surveying will also have to be carried out within the framework of the "dacha Amnesty": the terms of simplified registration of sections of SNT, LPH and DNP have been extended for the next "last" time until March 2021.
Free land surveying: Yes or no?
Changes in law 218-FZ did not lead to changes in the surveying procedure: it is still paid. But there are exceptions: if local governments need to clarify the boundaries of land plots in the blocks of suburban settlements, rural settlements, or within the city limits, the owners of these plots will have a chance for free land surveying. In other cases, you will have to pay for specifying the borders.
Stages of surveying
You will need to: collect documents confirming ownership; sign a contract with a cadastral engineer; inform the neighbors about the date of land surveying — their signatures will be on the final documents; get the boundary and technical plan of the site.
According to the results of land surveying, the site may grow: if the engineer sees that its actual size is less than indicated in the extract from the unified state register. But you can "cut" additional acres only at the expense of municipal land and in the amount of no more than 10% of the actual land area.
