2020-2021: garage owners will be able to legalize real estate in a simplified manner
According to various data, there are 3.5-5 million unregistered car boxes in Russia. In fact, citizens can't prove their right to buildings in any way. A simplified procedure for legalizing garages will help you sort out this issue. The adopted law was popularly called "garage Amnesty".
In 2021, after the law comes into force, owners of small real estate will be able to legalize it, as well as the land that the building occupies, through a simplified procedure. Having the appropriate document in hand, it will be possible to donate real estate, inherit it, sell it, or take out a loan. After all, many people know cases when the authorities took the land of individual garages and entire cooperatives to give it for development (in the legislation before there was not even the term "garage").
However, the owners did not always receive compensation. Now it is not so easy to withdraw the site will not work.
To legalize a garage in a simplified form, the structure must meet a number of requirements: be capital, have a Foundation (thus, shell garages will not fall under the Amnesty); built before December 31, 2004. (after that, a new Urban planning code came into effect, so buildings were already registered); be located on a state or municipal land plot.
After the start of the law in 2021, the owner of the garage should apply to the Federal registration service with a corresponding application, attaching documents confirming the right to real estate and land that he occupies. First, the land plot will be provided on a lease basis. After the garage is legalized, the land can be re-registered as property.
As you know, many garage owners in the past have already been able to legalize them. In this case, you need to write an application to become the owner of the land area under the legalized building.
According to the new law, the following documents will help to confirm the ownership of the garage: a contract that records the fact of purchase and sale; technical plan for the building; extract from technical inventory; the cooperative's decision on the distribution of this box; application to the Federal registration service for cadastral registration, registration of rights; receipts for payment of the share, repair and maintenance of the box in the relevant garage cooperative.
Regional offices of Rosreestr have the right to add other documents to this list.
